Unfortunately, sometimes law enforcement officers are poorly trained or supervised, and law enforcement agencies have policies and customs which create liability for the acts of law enforcement officers who in the scope of employment make false arrests, use excessive force or excessive deadly force, or deny necessary critical medical care of people who are incarcerated, sometimes even without a trial and conviction of any crime. Law enforcement will at times fail to investigate or ignore exculpatory evidence before exercising the awesome power of arrest. Additionally, officers who fail to intervene while another officer violates a personÕs constitutional rights may also be held liable. Our office will not only investigate and pursue federal claims under Section 1983, Title 42 of the United States Code, but will also investigate whether law enforcement violated any Florida Statutes.
